These Terms of Use (“Terms”) govern your access to and use of finalarrangements.co.za (the “Site”), operated by Final Arrangements (“we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About the Site

Final Arrangements is an independent online directory of funeral service providers across South Africa. We aggregate publicly available information about funeral homes and provide a platform for funeral home owners to claim, verify, and enhance their listings.

We are not a funeral service provider. We do not arrange funerals, sell funeral plans, or provide funeral insurance. Any transactions or arrangements are between you and the funeral service provider directly.

2. Use of the Directory

2.1 General visitors

You may browse the directory free of charge. The information provided is for general reference purposes only. While we make reasonable efforts to ensure accuracy, we do not guarantee that all listing details (contact numbers, addresses, services offered, pricing) are current or complete.

2.2 Funeral home owners

If you are a funeral home owner or authorised representative, you may claim your listing through the Site. By claiming a listing, you confirm that:

You are the owner or an authorised representative of the funeral home.
The information you provide is accurate and truthful.
You will keep your listing information up to date.
You consent to your business information being displayed publicly on the Site.

3. Account Registration

Certain features require you to create an account. When registering:

You must provide accurate and complete information.
You are responsible for maintaining the confidentiality of your login credentials.
You must notify us immediately of any unauthorised use of your account.
We may verify your identity and phone number via SMS (sent through BulkSMS). Standard SMS rates may apply from your mobile provider.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent.

4. Featured Listings and Payments

4.1 Featured listing tiers

Funeral home owners may upgrade their listing to a featured tier for enhanced visibility. Featured listings are clearly marked and do not affect editorial content or directory rankings beyond placement priority.

4.2 Payment processing

All payments are processed securely through PayFast (Pty) Ltd, a licensed payment service provider. By making a payment, you agree to PayFast’s terms of service. We do not store your credit card or banking details.

4.3 Refund policy

Featured listing fees are non-refundable once the listing has been activated. If you experience a technical issue preventing your listing from displaying correctly, contact us and we will resolve the issue or provide a pro-rata credit at our discretion.

5. SMS Verification

We use BulkSMS to send verification codes to the mobile number you provide during registration or listing claims. By providing your mobile number, you consent to receiving these verification messages. We will not use your number for marketing SMS without your explicit consent.

6. Content and Intellectual Property

6.1 Our content

All original content on the Site — including text, design, graphics, guides, and editorial material — is owned by Final Arrangements and protected by South African copyright law. You may not reproduce, distribute, or republish our content without prior written permission.

6.2 User-submitted content

When you submit information through the Site (listing details, descriptions, images), you grant us a non-exclusive, royalty-free licence to display, modify, and use that content in connection with the directory. You retain ownership of your original content.

6.3 Prohibited content

You may not submit content that is:

False, misleading, or deceptive.
Defamatory, abusive, or discriminatory.
In violation of any South African law or regulation.
Infringing on any third party’s intellectual property rights.

7. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available”. We make no warranties, express or implied, regarding:

The accuracy, completeness, or reliability of directory listings.
The quality, safety, or legality of services offered by listed funeral homes.
Uninterrupted or error-free access to the Site.

We strongly recommend that you independently verify all information — including pricing, service availability, and licensing — directly with the funeral service provider before making any arrangements.

8. Limitation of Liability

To the fullest extent permitted by South African law:

We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or reliance on directory information.
We are not liable for any disputes, losses, or damages arising from transactions between you and a funeral service provider found through the Site.
Our total liability, if any, shall not exceed the amount you have paid to us in the twelve months preceding the claim.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with POPIA.

10. Third-Party Links

The Site may contain links to third-party websites (funeral home websites, payment processors, government resources). We are not responsible for the content, privacy practices, or availability of these external sites.

11. Modifications to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Site after changes constitutes acceptance of the revised Terms. Material changes will be communicated via a notice on the Site.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the South African courts.
